TERMS AND CONDITIONS OF THE LITTLEADVENTURE.COM.PL STORE

The online store operating at littleadventure.com.pl is the property of Little Adventure Krystyna Chmielewska, with its registered office in Warsaw at 7/5 Portowa Street, hereinafter referred to as the "Seller".

These online store regulations, hereinafter referred to as the "Regulations", define the rules of operation of the online store run under the name Littleadventure.com.pl at the internet address www.littleadventure.com.pl, hereinafter referred to as the "Store", and the conditions for concluding and implementing sales contracts with buyers via the Store.

These Regulations become part of the contract concluded between the Seller and the Store's customer, hereinafter referred to as the "Buyer".

    General provisions
        The seller sells goods via the Internet. The condition for placing an order in the Store is:
        a) filling in the order form - for Buyers who do not use the account service in the Store, or
        b) placing an order after registering for the Store's account service
        The buyer of the products available in the Store may only be an adult who is a consumer within the meaning of the Civil Code (hereinafter "Buyer").
        The seller carries out orders only in Poland. In individual cases, after prior approval of the Store, it is possible to ship the goods to European Union countries, only via a courier company.
        The names of manufacturers and brands belong to their owners and are presented in the Store for informational purposes only. Photos and images of the products presented in the Store are not advertising within the meaning of the law, but only commercial information about the products within the meaning and may slightly differ from the actual appearance.
    Store offer
        The information on the store's website is only an invitation to conclude a contract in accordance with art. 71 of the Civil Code.
        The prices of goods in the Store are expressed in Polish zlotys. The prices include VAT, but do not include shipping costs, which will be calculated and communicated to the Buyer prior to the final approval of the order, along with all other additional costs (if any). The price presented for a given product is binding for the Buyer at the time of placing the order.
        The seller reserves the right to change the prices of the goods listed in the offer, which may not, however, adversely affect the order.
        The quantity and type of goods offered in the Store are variable and are constantly updated.
        The number of goods covered by a possible promotion in the Store is limited. Their sale is carried out on the basis of the order of orders confirmed by the Store, until stocks are exhausted.
        Each product purchased in the Store, in accordance with the obligations resulting from the provisions of law, is brand new, free from defects and has original tags.
    Execution of the contract
        Before the final order placement, the Buyer will be able to read the information regarding the order being placed, which will include, inter alia, individual elements of the order (goods) and all costs charged to the Buyer, including the unit price and the total price (i.e. including tax), the value of any discounts and the exact delivery costs.
        After placing the order, the Seller will generate information about the order details, which will be sent to the Buyer's e-mail address provided in the order form or assigned to the account service in the Store. The Buyer undertakes to pay the amount of money related to the placed order, on the terms and within the time limits specified in these Regulations.
        The order fulfillment time is the time needed to prepare the order for shipment. The Seller undertakes to make every effort to ensure that it amounts to a maximum of:
        a) 24 hours from the payment of the order in the case of shipments of products where the information "shipment date - 24h" appears; or
        b) 3 days from the moment the payment for a given order is credited to the Seller's bank account.
        In the case of goods that in the description contain information about the date of bringing the goods from the external warehouse or from the importer or from the warehouse, example of information: "shipping date - 3 days". For all other goods that do not have any of the above information, the delivery time from point 3.3.
        Orders placed on weekends and public holidays are processed within 24 hours from the first working day, but excluding subsequent public holidays.

In the event that the order cannot be processed due to the lack of the selected product in the Seller's warehouse or the exhaustion of the assortment, the Buyer will be informed about it and will be able to change or cancel the order.
        The order is considered valid and binding only if the order form has been correctly completed by the Buyer and sent to the Store using the registration system or mechanisms contained on the Store's websites, unless the law provides otherwise.
        The Buyer may correct the order only before its approval for implementation by the Seller, which does not exclude the Buyer's right to withdraw from the contract in accordance with the law. The buyer should submit a correction to the order by e-mail, and until its validity, the correction must be confirmed by e-mail by the Seller.
        The order sent by the Seller may not be canceled, except for the cases described in these Regulations.
        In individual cases, accepted by the Seller, it is also possible to cancel an order that has been paid for but not yet shipped by the Seller.
        After sending the order to the Buyer, the Store will notify the Buyer about it via the e-mail provided by the Buyer in the order form.
    Cost and method of delivery
        The delivery of the order is carried out using:
        - DPD courier
        - InPost parcel lockers
        - Pickup in person in Warsaw at ul. Portowa 7 m 5, 03-197
        The cost of shipping is borne by the Buyer, who is informed about the total cost of delivery before the final approval of the order. Information about the order and the cost of delivery of the order will also be sent to the Buyer by e-mail, after placing the order, to the address provided in the order form or assigned to the account service in the Store.
        If possible, the buyer should check the condition of the shipment when collecting it in the presence of an employee of the courier company. In the event of damage to the parcel, the Buyer should, if possible, report this fact to the courier and draw up a complaint protocol and inform the Seller about this fact.
        The cost of returning the shipment to the Seller in the event of the Buyer's exercising the warranty right is covered by the Seller - in this case, the Seller very much asks for prior contact initiated by the Buyer with the Seller at the phone number 509 225 189 or e-mail: shop@littleadventure.com.pl, in order to agreeing the terms and dates of sending the defective goods to the Seller.
        The cost of foreign delivery is determined individually, according to the courier company's tariff. The seller does not carry out foreign shipments with cash on delivery.
    Payment methods
        The buyer may make the payment as follows:
        - By transfer to the bank account: mBank (IBAN) PL14 1140 2004 0000 3202 3767 5718, the transfer title must include the order number.
        - Through the secure PayU S.A. system (payu.pl)
        - Payment in cash on personal collection at the company's seat - ul. Portowa 7 m 5, 03-197 Warsaw.
        After receiving the payment, the Store confirms the acceptance of the order by e-mail. If the payment is not made to the Seller's bank account within 5 working days from the date of sending the Buyer the message summarizing the order, referred to in point 3.2 above, the order will be considered not placed.
        In exceptional cases, it is possible to negotiate the payment date, but to be valid, the request made by the Buyer must be accepted by the Seller.
    Withdrawal from the contract
        The buyer has the right to withdraw from the concluded contract within 15 days from the date of receipt of the shipment with the order, without giving any reason. Withdrawal is possible only if the item is not destroyed or damaged for reasons attributable to the Buyer to a greater extent than resulting from ordinary management, i.e. using the item in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.
        In the event of withdrawal from the contract, the Buyer should inform the Seller about this fact in the form of a declaration, the model of which is the Return Form.
        a) by e-mail to the following address: shop@littleadventure.com.pl, or
        b) by post to the following address: Littleadventure.com.pl u. Portowa 7 m 5, 03-197 Warsaw with the annotation "WITHDRAWAL FROM THE AGREEMENT"
        each time, with an indication of which order or goods the withdrawal concerns. To meet the deadline specified in point 6.1. it is enough to send the statement before its expiry.

The buyer should send back the goods properly packed (i.e. protected against damage), if possible with all tags, within 14 days of the withdrawal in the manner indicated in point.
        The Seller undertakes to consider the withdrawal from the contract immediately, counting the day of receipt of the item or delivery to the Seller of a proof of its return, depending on which event occurs first, respecting the provisions of paragraph 6.1 - 6.3. above. If all the circumstances referred to in the preceding sentence are met, the payment due to the Buyer will be returned immediately using the same method of payment as used by the Buyer, unless the Buyer clearly indicates a dedicated bank account - in case of doubt, the Seller will contact the Buyer to their explanations.
        If the Buyer has chosen a delivery method other than the cheapest standard delivery method offered by the Store, the Seller is not obliged to reimburse the Buyer for any additional costs incurred by the Buyer.
        The consumer bears only the direct cost of returning the item.
        The right to withdraw from the contract is not available to the consumer in relation to contracts:
        a) in which the subject of the service is a non-prefabricated item, manufactured according to the Buyer's specifications or serving to satisfy his individual needs,
        b) in which the subject of the service is an item that deteriorates quickly or has a short shelf-life,
        c) in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging was opened after delivery,
        d) in which the subject of the service are items that after delivery, due to their nature, are inseparably connected with other items,
        e) in which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the package has been opened after delivery,
        f) for the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts,
        g) concluded through a public auction,
        h) for the delivery of digital content that is not recorded on a tangible medium, if the performance began with the Buyer's express consent before the deadline to withdraw from the contract and after informing him by the Store about the loss of the right to withdraw from the contract.
    Complaints
        The Buyer has the right to make a complaint about the goods purchased in the Store as a result of the non-compliance of the goods received with the placed order, delays in delivery due to the Store's fault and other cases resulting from generally applicable law.
        Complaints are not subject to: natural wear and tear of the goods, mechanical damage (bruises, abrasions, tears) resulting from the use of the goods, damage resulting from improper use and maintenance or poor fit of the goods (if applicable).
        The Buyer should send back the goods in question, if possible, in the original packaging and with the proof of purchase (receipt / invoice) and the request regarding the purchased goods, so that the Buyer's claims can be identified. Repaired or replaced with a new product is delivered to the Buyer at the Seller's expense.
        The seller undertakes to consider the complaint in accordance with generally applicable law.
        Complaints as well as goods subject to complaint should be sent to the following address: Little Adventure ul. Portowa 7 m 5, 03-197 Warsaw with the annotation "COMPLAINT".
    Exchange
        The buyer has the right to replace the purchased goods within 15 days from the date of receipt of the shipment, without giving a clear reason for the replacement. It is possible only if the product is not damaged or used in any way. The Seller should be informed about the intention to replace the goods by e-mail or by phone. Exceeding the deadline will be the basis for not taking the exchange into account.
        The exchanged goods should be sent in the original packaging, with all tags, together with the proof of purchase (receipt / VAT invoice).
        The seller undertakes to send the replaced goods within 10 working days.
        The cost of shipping the replaced and replaced goods is borne by the Buyer.
        The seller does not accept cash on delivery shipments.
        The goods subject to exchange should be sent to the following address: Little Adventure ul. Portowa 7 m 5, 03-197 Warsaw with the annotation "EXCHANGE OF GOODS".
    Out-of-court ways of dealing with complaints and redress
        The Buyer may use extrajudicial means of dealing with complaints and pursuing claims from the Seller
        Detailed information on the rules of access to the procedures described in paragraph 1 are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodeship Inspectorates of the Trade Inspection - the list of the above is available at the following internet address: http://www.uokik.gov .pl / wazne_adresy.php.

    Personal data protection
        Personal data provided by the Buyer will not be made available to other entities, except for persons who will be directly involved in the implementation of a given Buyer's order (e.g. a courier company). Providing personal data is not the responsibility of the Buyer, but it is necessary for the correct implementation of the order placed by the Buyer via the Store. The data administrator is the Seller, i.e. Little Adventure, with its registered office in Warsaw at 7 Portowa Street
        Personal data of Buyers who make payments via PayU for the purchased goods / products / services are transferred to PayU S.A. based in Poznań, as the data controller (60-324 Poznań, ul. Marcelińska 90), entered into the register of entrepreneurs kept by the District Court Poznań - Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register under the number KRS 0000274399. The transfer concerns personal data necessary to complete the payment by PayU S.A.
    Final Provisions
        The Seller may make changes to these Regulations, provided that such changes are justified due to, for example, the important interest of the Seller or the Buyers, and these changes may not worsen the situation (rights) of the Buyers. Amendments to the Regulations in relation to Buyers using the account service in the Store shall apply from the moment they accept the amended Regulations. The Seller reserves that with regard to Buyers using the account service in the Store, certain functions of the Store or even the ability to make purchases in the Store may be limited or even impossible until the acceptance of the amended Regulations, which, however, does not apply to already ordered goods.
        These Regulations are a document specifying the rules for placing orders in the Store. Each Buyer is obliged to read the content of the Regulations, and its provisions become binding for him at the time of placing an order in the Store or appropriately accepting the Regulations (in the case of Buyers using the account service in the Store).
        In matters not covered by these Regulations, the provisions of the Act on consumer rights, the Civil Code and other relevant legal provisions shall apply.
